PatSeer Generative AI Additional Terms and Conditions
What you primarily need to know:
- PatSeer’s AI capabilities such as AI search, AI refine, summarize or classifier did not require any user content to be sent to an external service such as a GenAI model provider and were processed within PatSeer’s secure cloud infrastructure.
- PatSeer’s GenAI capabilities such as the AI Assistant and other future GenAI capabilities leverage third-party LLM models provide by trusted enterprise partners as Azure OpenAI and Amazon Web Services Bedrock. We do not send any user content directly to LLM model providers such as OpenAI or Anthropic.
- By leveraging Azure and AWS Bedrock, each of which have advanced tools such as virtual networking to ensure tighter control over user content and security compliances needed by enterprises, PatSeer ensures that:
- user content is isolated and not available to any other customers
- user content is not available to the model provider such as OpenAI or Anthropic
- user content is not used to improve or train OpenAI’s or Anthropic’s models
- user content is not used to improve or train Azure Open AI Service foundational models or AWS Bedrock Anthropic foundational models
- stored user content, if any, is encrypted by PatSeer managed keys
- All GenAI features present in PatSeer will be indicated accordingly within the application (and are also mentioned at the end of this document) so that the customer clearly knows which are GenAI and which aren’t.
- While PatSeer has put maximum guardrails against GenAI giving incorrect analysis and/or hallucination, there is no guarantee that it will not happen.
Additional Terms and Conditions (November 2024)
PatSeer Generative AI Additional Terms and Conditions (“GenAI Additional Terms”) govern your (“the Customer”) use of the generative artificial intelligence features (“GenAI Features”) provided by PatSeer Technologies Pvt Ltd. These GenAI Terms are an integral part of the Agreement between PatSeer and the Customer if the GenAI Features are included in the plan selected by the Customer or subsequently opted into by the Customer.
Unless explicitly defined otherwise herein, capitalized terms shall have the meanings assigned to them in the Agreement and the General Terms of Service.
1. APPLICABILITY
1.1 These GenAI Terms apply to the use of GenAI Features available within PatSeer Services. The GenAI Features offer high value in patent-related tasks, such as data review, summarization, technical analysis, and comparisons.
1.2 These GenAI Terms may be supplemented by specific product terms. In the case of any conflict between the GenAI Terms and other documents in the Agreement, the following order of precedence will apply: Ordering Document, Product-specific terms, these GenAI Terms and End User License Agreement.
1.3 By approving these GenAI Terms, the Customer consents to enable the GenAI Features for their organization. These features can be disabled by PatSeer at the request of the Customer at any time.
2. DEFINITIONS
2.1 User Content: Input from a user, such as a query or command, used to guide the Services in generating an Output using the GenAI Features.
2.2 Output: Text, information, or other generated content provided by the GenAI Features in response to User Content.
3. USAGE
3.1 The Customer may provide User Content for the purpose of generating Outputs using the GenAI Features. The Customer warrants that they have all the necessary permissions, to use such User Content.
3.2 When accessing or using the Services, Users must not submit User Content that violates any applicable laws or infringes third-party rights. This includes ensuring no personal data (as defined by applicable law) that infringes any legal rights is provided.
3.3 PatSeer does not, and will not permit its third-party service providers to, use User Content, or Outputs for the training, development, or fine-tuning of generative models.
4. OUTPUTS AND RIGHTS
4.1 Subject to the use restrictions set forth in the Agreement, and to the extent permitted by applicable law, the Customer retains ownership of the Outputs generated through the GenAI Features. A limited, non-exclusive, royalty-free license to use portions of the Output that include PatSeer’s intellectual property is granted to the Customer, but does not imply transfer of ownership.
4.2 The Customer may not use PatSeer’s or third-party providers’ property for the training of artificial intelligence models, the creation of derivative works, or any purposes that violate intellectual property rights or applicable laws.
5. USE OF EXTERNAL SERVICES
5.1 PatSeer aims to host all GenAI Features within its own cloud environment. However, to expedite providing value to Customers, trusted external services may be used to host specific models and functionalities (“External Services”). Only services evaluated as trusted and compliant with PatSeer security standards will be used.
5.2 PatSeer will never send User Content to External Services without Customer approval, and ensures no External Service claims ownership over User Content or uses it to train their models for the public good.
5.3 External services currently include trusted partners such as Azure OpenAI and AWS Bedrock Anthropic, which meet the following minimum requirements:
- They do not use input prompts for training their own models.
- They encrypt the user content with keys generated by their Cloud customers (such as PatSeer) and thereby ensure that the model owners can never access stored user content
- They do not claim any ownership whatsoever over User-generated content.
6. DISCLAIMERS
6.1 The Outputs generated by GenAI Features are provided “as is” without warranties of any kind. PatSeer makes no guarantees regarding the accuracy or correctness of Outputs, and Customers are encouraged to verify Outputs with primary sources before use.
6.2 Use of the GenAI Features and Outputs is at the Customer’s own risk.
7. CHANGES
7.1 PatSeer may revise these GenAI Terms from time to time. Upon a change, users will be prompted to review and accept the revised terms and conditions prior to continuing the use of the GenAI capabilities. By continuing to use the GenAI Features after the revised GenAI Terms are posted or communicated, the Customer agrees to the revised GenAI Terms. If the Customer does not accept the revised GenAI Terms, use of the GenAI Features must be discontinued.
